2. Definitions
2.1 Online shop: BABYCHICKATELIER's website which includes information about the products available for sale, prices, any discounts, shipping rates and General Conditions of Sale, through which any customer can place orders and request quotes. Customers will be able to register on the platform, giving them a username and password that will allow them access to a reserved area where they can place orders and request quotes.
2.2 B2C customer: end consumer.
3. Privacy Policy
BABYCHICKATELIER collects the customer's personal data for the purposes of managing the customer account, invoicing, providing information, as authorised by the customers for this purpose, and is committed to privacy and security in the processing and maintenance of each customer's personal data, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation). 4. Prices and Products
4.1 The products presented in the online shop are commercialised by BABYCHICKATELIER, and their stock status may or may not vary depending on internal orders to suppliers.
4.2 The prices in the online shop are in Euros (€), are expressed per unit of measurement and may be changed without prior notice until the time of payment, which may cancel the existing order. It is up to BABYCHICKATELIER whether or not to accept the order.
4.3 Postage and transaction commission costs may also be added to the prices.
4.4 Prices and specifications are subject to change without prior notice. However, once the order has been validated, prices cannot be changed.
4.5 The applicable discounts, if any, are available in the customer's reserved area and are only valid for each order and for existing stock.
5. Ordering
5.1 Order request
5.1.1 The possibility of placing an order in the online shop is restricted to registered users whose delivery and billing addresses are in mainland Portugal (for other locations, on request). Furthermore, BABYCHICKATELIER reserves the right to only accept registration requests for the website if the user sends true and consistent information and only if the delivery address of the order is in mainland Portugal (for other locations, on request).
5.1.2 For greater rigour, guarantee and quality of information, if orders are not placed in the online shop, they must be formalised in writing and sent to geral@babychickatelier.com. Orders must clearly define the products, quantities and place of delivery required.
5.1.3 By formalising the order, the customer/user declares to accept the General Terms and Conditions of Sale, the price list and the shipping prices available in the online shop.
5.1.4 The B2C customer accepts the order from the moment they formalise their purchase (by the means available to them) and make payment.
5.1.5 If the product is unavailable, BABYCHICKATELIER undertakes to inform the customer/user and reimburse him/her for any amounts paid within a maximum of 10 (ten) days from the date of knowledge of such unavailability.
5.1.6 BABYCHICKATELIER reserves the right not to accept the order in question if it considers there to be misconduct on the part of the customer or any inconsistency in the personal data recorded.
5.2 Delivery of the parcel
5.2.1 All orders placed in the online shop on the website will be dispatched by carrier, unless they are picked up at BABYCHICKATELIER's premises.
5.2.2 The estimated delivery times for goods are indicative and are defined in the availability information associated with each item. If you order items subject to different delivery times in a single order, the longest delivery time for the items in the order will be taken as the delivery time for the entire order.
5.2.3 Made-to-order products have a variable delivery time, depending on the type of item and the quantity.
5.2.4 B2C customer orders in the online shop consisting of unavailable items and items out of stock will only be dispatched once all items are available. If this is not the case, the customer must place separate orders.
5.2.5 BABYCHICKATELIER reserves the right to refuse orders where they are made up of products that cannot be guaranteed to be delivered in good condition in small quantities.
5.2.6 Upon delivery of the goods, the customer or the person appointed by the customer to receive the goods must check the external condition of the packaging and ensure that all the quantities mentioned have been received, in order to report any non-conformities to the delivery organisation and, within one day, to inform BABYCHICKATELIER in writing. The Customer must explain the non-conformity or damaging situation precisely and sign and date the delivery note. BABYCHICKATELIER cannot accept any liability towards the transport company if the delivery note is not duly completed.
5.2.7 BABYCHICKATELIER shall not be liable for any delays in deliveries caused by force majeure or unforeseen circumstances such as breakdowns, strikes, etc.
5.2.8 Outside mainland Portugal, delivery conditions will be negotiated and established on an order-by-order basis.
5.2.9 When transport is carried out by the customer or by an intermediary contracted by the customer, the products are the responsibility of the customer after leaving BABYCHICKATELIER's premises.
5.2.10 BABYCHICKATELIER reserves the right to change the delivery conditions in specific, duly justified cases.
6. Delivery charges

Delivery Mainland Portugal - €5.00+VAT if the value of the purchase sent is less than €100+VAT. If the purchase value is higher, postage is free. Delivery to other locations (outside mainland Portugal) - On request
7. Payment terms
7.1 All orders placed on our platform are paid for in advance by credit card, PAYPAL debit card, ATM or bank transfer.
8. Exchanges, Returns and Order Cancellation
8.1 Conditions for Material Exchanges
8.1.1 If the Customer receives their order and finds that the product does not correspond to what they wanted, they have a period of ten (10) days from the date of receipt to exercise their right to exchange or return it.
8.1.2 The product must be in perfect condition, in its original sealed packaging, and contain all manuals and accessories.
8.2 Exclusions: if the product fulfils any of the following conditions, BABYCHICKATELIER reserves the right not to accept the exchange or return:
a) If the product or size is not in our stock and has been specifically ordered for the customer;
b) If the product has been customised in any way;
c) Sealed products that have been opened after delivery;
d) Products that have been opened after delivery and are not suitable for return for hygiene reasons;
e) If the product has been used or tested;
f) If the item is on sale;
g) If the article in question has already been exchanged;
h) If the exchange or return request is made after 15 days from the date of receipt of the material.
8.3 How to exchange or return
a) So that we can serve you quickly and efficiently, please send an email to geral@babychickatelier.com with the following information: your identity, email address, telephone number, invoice number, product reference, indication of the intention to exchange or return, identification of the reason for the exchange/return.
b) After approval of the exchange/return, the item must be delivered by hand or sent to TALENTOPINION, Lda., Avenida Marquês de Pombal, nº3 r/c loja 8 - 2380-011 Alcanena - and accompanied by the original purchase document.
c) Once we have received the goods at our premises and checked their condition, we will issue a Credit Note for the product in the case of a return, or issue a Credit Note and invoice for the correct product in the case of an exchange.
d) In the event of a return, payment will be made by bank transfer after deduction of postage costs. To do this, please provide us with your NIB/IBAN number. The transfer will be made within a maximum of 10 working days from the date your return is processed.
e) In the event of an exchange or return due to a customer error, the transport costs for collection and/or replacement will be borne by the Customer. These correspond to the Postage Table.
f) If the reason for the exchange or return arises from incorrect despatch by BABYCHICKATELIER, the costs of despatch and collection will be borne by BABYCHICKATELIER, provided that the customer notifies BABYCHICKATELIER within 10 days of receipt of the item or on the first working day thereafter if the deadline falls on a Saturday, Sunday or public holiday.
g) Returns will only be accepted within a maximum of 10 days or on the first following working day if the deadline falls on a Saturday, Sunday or public holiday, from the date of delivery and expressly authorised by BABYCHICKATELIER.
8.4 Conditions for Cancellation of Orders
a) The customer may withdraw from the order as long as it has not yet been processed. The customer must mention the order number, the tax number associated with the website registration and the reason for cancellation. Order cancellations should only be formalised by email to the following address: geral@babychickatelier.com
b) The refund of the money relating to the cancelled order will be processed via bank transfer as soon as both parties (customer and BABYCHICKATELIER) agree to the cancellation. Any payment fees will not be refunded.
c) If the order has already been processed, BABYCHICKATELIER reserves the right to invoice up to 80% of the value of the order if the customer cancels it.
9 Complaints and suggestions
9.1 As part of its Quality Management System, BABYCHICKATELIER evaluates and handles customer information and complaints according to a set of procedures. This system guarantees rigorous monitoring of the process and the pursuit of customer satisfaction.
9.2 BABYCHICKATELIER cannot be held responsible for colour variations in products caused by partial orders or different batches. Therefore, orders for coloured items should always be placed taking into account all the quantities required to carry out the desired plan.
9.3 Returns are not accepted for made-to-order products, which are manufactured or purchased exclusively to fulfil the customer's request.
9.4 In all other cases, returns will only be accepted within a maximum of 10 days or on the first following working day if the deadline falls on a Saturday, Sunday or public holiday, from the date of delivery and expressly authorised by BABYCHICKATELIER.
9.5 In the event of a complaint, it must be formalised in writing and contain the details of the label and other identifying elements of the product(s).And because it is very important for us to understand your issue, we ask you to set out the facts, detailing what you want to geral@babychickatelier.com. In order for us to be able to respond more quickly, please give us as much information as possible and leave us your telephone number.

10 Agreed domicile
10.1 By contracting with BABYCHICKATELIER, the customer expressly agrees that the address provided by the customer shall be deemed to be the agreed domicile for all legal purposes, consenting to any letters, communications or judicial or extrajudicial notices that may be sent to the customer being sent to said address.
11 Applicable law and jurisdiction
11.1 The applicable law is Portuguese law.
11.2 For the out-of-court settlement of disputes arising from contracts entered into under these General Conditions of Sale, the buyer may use the Conflict Mediation Centre, located at CNIACC - Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, Faculdade de Direito da Universidade Nova de Lisboa, Campus de Campolide, 1099-032 Lisboa.
11.3 In the event of legal proceedings, the courts of the District of Entroncamento shall have jurisdiction, expressly waiving any other jurisdiction.
11.4 In all matters not duly provided for in these General Conditions of Sale, the procedural and substantive legal provisions in force shall apply in addition.
12 Amendment and validity
12.1 BABYCHICKATELIER reserves the right to unilaterally amend or revoke these General Terms and Conditions of Sale without prior notice.
12.2 The provisions set out in the General Conditions of Sale may only be waived by a written document signed by both parties.
12.3 These General Conditions of Sale come into force on 1 January 2022.
